The law firm of Brooks, Frank and De la Guardia, concentrates its practice on federal bankruptcy law.  Michael Frank established the firm in 1982 and was joined, nine years later, by Michael Brooks.  Rudy De la Guardia joined the firm in 1992.

Michael Frank

Mr. Frank is one of the founding partners of the firm.  Mr. Frank specializes in consumer bankruptcy law and has been practicing in this area for 30 years. His undergraduate degree is from the University of Florida.  He earned his Juris Doctor degree from the University of Florida School of Law in 1981.  He is admitted to practice in the state of Florida and is a member of the Florida Bar. He is also a member of the United States Circuit Court of Appeals for the 11th Circuit and the United States District Court for the Southern District of Florida and the United States District Court for the Middle District of Florida.

Mr. Frank is recognized with a level of expertise in this area of the law.  He has participated on numerous panels and has lectured around the country in reference to the ongoing issues in consumer bankruptcy law and more recently on the changes to U.S. Federal Bankruptcy Code implemented by the Bankruptcy Abuse Prevention Consumer Protection Act of 2005 (BAPCPA).

Mr. Frank has been a guest lecturer at the University of Miami School of Law and the St. Thomas University School of Law.  He belongs to the National Association of Chapter 13 Trustees and the National Association of Consumer Bankruptcy Attorneys.  He has been on the local rules committee for the Southern District of Florida, Bankruptcy Court.

 

Michael Brooks

Mr. Brooks has been a name partner with the firm since 1990.  He concentrates his practice in consumer bankruptcy law and has been practicing in this area since coming to the firm 22 years ago.  Presently, Mr. Brooks focuses his practice in Chapter 7 and Chapter 13 consumer bankruptcy matters and handles complex litigation in those areas.

He has been a member of the Florida Bar since 1984.  He has an undergraduate degree from the University of Florida.  He earned his Juris Doctor degree from Nova Southeastern University School of Law in 1984. He is admitted to practice law in the state of Florida.  In addition, Mr. Brooks is a member of the United States District Court for the Southern District of Florida.  He is also a member of the United States District Court  for the Middle District of Florida

Mr. Brooks has been a guest lecturer, teaching bankruptcy to law students at the University of Miami School of Law.  He has experience in several other areas of the law including personal injury, real estate, corporate, probate and the drafting of wills.

 

Rodolfo De la Guardia

Mr. De la Guardia joined the firm in 1992.  He became a name partner in 2000.  He concentrates his practice on consumer bankruptcy law.  It has been his primary area of practice since he became an attorney.

He has been a member of the Florida Bar since 1991.  He graduated with a Bachelor of Arts degree from the University of Miami in 1986.  He earned his Juris Doctor degree from the Thomas M. Cooley Law School in Lansing, Michigan in 1991.  Mr. De la Guardia is admitted to practice law in the state of Florida.  In addition, he is a member of the United States District Court for the Southern District of Florida.

Mr. De la Guardia has held the rank of Ambassador on Special Mission for the Republic of Panama and the rank of Honorary Consul for the Republic of Panama’s Consulate in Miami, Florida.

Mr. De la Guardia has experience in personal injury, real estate and immigration.  Presently, Mr. De la Guardia concentrates his practice in Chapter 7 and Chapter 13 Consumer bankruptcy.

In addition, he was the Vice Chairman and Treasurer of the City of Miami Investigative Panel with oversight of the Miami Police.  He previously sat on the City of Miami Zoning Board and the City of Miami Code Enforcement Board.
